Terms of Service

1. Agreement to Terms

By accessing or using Automania's services, website, or any related platforms (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our Services.

2. Description of Services

Automania provides custom automation and digitalization solutions on a subscription basis. Our Services include but are not limited to workflow automation, system integration, data centralization, and related consulting. The scope and nature of deliverables are defined by the subscription plan selected by the client.

3. Subscription & Billing

All subscriptions are billed monthly unless otherwise agreed upon. Payment is due at the start of each billing cycle. Failure to pay may result in suspension of Services. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial months of service.

4. Intellectual Property

All work product, deliverables, and automations created by Automania for a client become the property of the client upon full payment. Automania retains the right to use generalized knowledge, techniques, and methodologies developed during engagements for future projects, provided no client-specific confidential information is disclosed.

5. Client Responsibilities

Clients agree to provide timely and accurate information, access credentials, and feedback necessary for Automania to deliver its Services. Delays caused by the client's inability to provide required resources may impact delivery timelines.

6. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary and sensitive information shared during the course of the engagement. This obligation survives the termination of the agreement for a period of two (2) years.

7. Limitation of Liability

Automania's total liability for any claims arising from or related to the Services shall not exceed the total fees paid by the client during the three (3) months preceding the claim. Automania shall not be liable for any indirect, incidental, consequential, or punitive damages.

8. Termination

Either party may terminate the agreement with thirty (30) days' written notice. Automania reserves the right to terminate Services immediately if the client breaches any material term of this agreement. Upon termination, the client retains ownership of all completed deliverables for which payment has been received.

9. Modifications

Automania reserves the right to modify these Terms of Service at any time. Changes will be communicated via email or posted on our website. Continued use of the Services after such changes constitutes acceptance of the modified terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration.
